Who Can Use This Site

You need to be at least 18, or the age of majority where you live, to use this site or place an order. If you're between 13 and 18, you're welcome to browse with a parent or guardian's permission, but you'll need them to complete any purchase on your behalf. This site isn't intended for children under 13, and we don't knowingly collect information from anyone that age. Our Privacy Policy covers that in more detail.

Acceptable Use

Use the site the way it's meant to be used. That means you agree not to interfere with how it functions, attempt to gain unauthorized access to any part of it, scrape or copy content in bulk without our permission, use the site for anything illegal, submit false information when placing an order or contacting us, or infringe on our intellectual property or anyone else's. We reserve the right to investigate and take appropriate action, including restricting access, if we believe someone is violating these terms.

Intellectual Property

Everything on this site, including text, graphics, product photos, logos, and the names of Xiafy Group and its brands, belongs to us or our licensors. You can look at it, share a link to it, and use it the way any normal visitor would. What you can't do is copy, reproduce, or repurpose it for your own commercial use without asking us first. Our brand names are trademarks of Xiafy Group, whether or not they carry a trademark symbol on any given page.

Products, Orders, and Order Acceptance

Right now, xiafy.com is a parent company site. It's not set up to sell anything directly. Once we launch our brands, each will operate under Xiafy Group and will have its own product listings, pricing, and checkout process, though this document will apply across all of them.

When that time comes, placing an order is an offer to buy, not a guaranteed sale. We can accept or decline any order for reasons that include a pricing or listing error, suspected fraud, an item being out of stock, or a problem with payment. If we decline an order after you've paid, we'll refund you in full. An order is considered accepted once you receive a confirmation email from us, not before.

Pricing and Payment

Prices are listed in the currency shown on each brand's site and can change without notice. We do our best to keep pricing accurate, but mistakes happen occasionally, and if a listed price is clearly wrong, we're not obligated to honor it. Taxes and shipping costs are added at checkout and aren't included in the listed price unless we say otherwise. Payment is due when you place your order, through whichever payment method the brand's site supports at the time.

Shipping and Returns

Shipping timelines, costs, and our returns process will be covered in a separate shipping and returns policy for each brand once it launches, since the details can vary by brand and by product. That policy works alongside these terms, not instead of them.

Disclaimers

We provide this site and, eventually, our products, on an "as is" and "as available" basis. We don't promise the site will be free of errors or interruptions, and beyond what's legally required, we don't offer warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose. If you're buying a physical product from one of our brands, any warranty that applies will be stated on that product's listing or required by law in your jurisdiction.

Limitation of Liability

To the extent the law allows it, Xiafy isn't liable for indirect, incidental, or consequential damages arising from your use of the site or purchase of a product, including lost profits or data. Where liability can't be excluded entirely, it's limited to the amount you actually paid for the product or service in question. Some places don't allow these kinds of limitations, so depending on where you live, some of this may not apply to you.

Indemnification

You agree to cover us for any claim, loss, or expense, including reasonable legal fees, that comes from your violation of these terms or your misuse of the site.

Third Party Links

Our site may link to other websites or services we don't control, including social platforms or shipping and payment partners. We're not responsible for their content, their policies, or anything that happens once you leave our site. Visiting a linked site is your call, and it's worth checking their own terms and privacy practices.

Termination

We can suspend or end your access to the site at our discretion, particularly if we believe you've violated these terms, without needing to give advance notice in every case. If you'd rather stop using the site yourself, you're free to do that at any time.

Governing Law and Dispute Resolution

These terms are governed by the laws of the State of Wyoming, without regard to its conflict of law principles. If a dispute comes up, we'd genuinely rather sort it out directly, so reach out to [email protected] first and give us thirty days to work it out with you before anything more formal happens.

If we can't resolve things informally, any dispute arising out of or related to these terms or your use of the site will be settled through binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, conducted on an individual basis rather than as part of a class, consolidated, or representative action. Either of us can still bring an individual claim in small claims court instead, if it qualifies.

If you live somewhere that doesn't allow mandatory arbitration of consumer disputes under local law, this arbitration provision doesn't apply to you, and any dispute will instead be handled in the courts that have jurisdiction over your location, or in the courts of Wyoming if you'd prefer.

You can also opt out of this arbitration provision entirely. To do that, email [email protected] within thirty days of first using the site and let us know you're opting out. If you do, any dispute between us will be handled in court rather than through arbitration.

Changes to These Terms

We may update these terms as the business grows, especially once our brands are live or if we become a formally registered company. When we do, we'll update the effective date at the top of this page. Continuing to use the site after a change means you accept the updated terms, so it's worth checking back occasionally if you're a regular visitor or customer.
